SC quashes BHC’s decision in Recko Dik corruption case

ISLAMABAD: The Supreme Court (SC) on Thursday set aside the Balochistan High Court order in the Reko Dik corruption case, and restrained the National Accountability Bureau (NAB) from arresting the accused for 60 days, ARY News reported.

A three-member Supreme Court (SC) bench headed by CJP Justice Umar Ata Bandiyal heard the matter against the Balochistan High Court’s decision to grant bail to the accused.

The CJP, in its remarks during today’s hearing, said that two accused were granted post-arrest bail and eight others were granted pre-arrest bail by the BHC without any compelling reason.

The CJP remarked, the norms of bail have changed and without reviewing the facts, bail cannot be granted to the accused.

Setting aside the BHC’s decision in the Recko Dik corruption case, directed the accused to approach the NAB court within 60 days and restrain the corruption-buster body from arresting the accused during the said period.

CJP Justice Omar Ata Bandiyal said, “We are not sending the accused to jail, but are sending them to a ‘relevant’ forum for decision.”

It is noteworthy that the National Accountability Bureau (NAB) had challenged the decision of BHC in the Recko Dik corruption case.

In March 2022, the then Finance Minister Shaukat Tarin announced that an agreement had been reached with a foreign company Barrick Gold for the development of the Reko Dik mine, according to which Balochistan would own 25%.

Pakistan and Tethian Copper Company (TCC) have agreed to split the shares, with each party receiving 50 percent of them, as opposed to 25 percent of the shares for Pakistan in the previous deal.

In 2019, Pakistan managed to reduce the hefty fine in the Reko Diq case from $16bn to $6bn.
